FC NAPLES SEASON TICKET AGREEMENT

The FC Naples (“FC Naples”) hereby provides the following season ticket agreement (the “Agreement”).
This Agreement applies to FC Naples Season Ticket Memberships (individually, a “Membership,” collectively, the “Memberships”). The breach by a Member (defined below) of any of the provisions contained herein will automatically terminate the grant of license and benefits provided by the Membership.
In this Agreement:
“FC Naples” means the professional United Soccer League (“USL”) team operated by FC Naples USL LLC.
“Member” or “Holder” means an individual or entity who has purchased or is in possession of a Membership for FC Naples.
“Season” shall mean a single regular season of the Club for which a Membership is purchased, as determined by such Club’s League, but shall in all circumstances include pre-season and exclude post-season games.
USL Championship and USL League One shall each be individually referred to herein as a “League” and collectively as the “Leagues.”
Paradise Coast Stadium and its surrounding facilities, including all surrounding parking areas, pedestrian plazas, entryways, and other ancillary areas, shall be referred to herein each individually as a “Stadium” and collectively as “Stadiums.”
SEASON TICKET MEMBERSHIP BENEFITS
The following is a summary of Season Ticket Membership benefits (“Benefits”) for FC Naples as of the date of this Agreement. These Benefits are subject to change without notice:
All FC Naples Season USL home matches
First rights to purchase same seats for FC Naples home Lamar Hunt U.S. Open Cup and Scotiabank CONCACAF Champions League Matches (excluding finals)
First rights to purchase same seats for all playoff games at Paradise Coast Stadium
The ability to purchase additional tickets at a discount prior to public on-sale and throughout the season
Invites to special events and experiences
Member gift (varies each season)
Member discount at the team store
Ticket transfer program
Priority access to events at Paradise Coast Stadium
AUTOMATIC RENEWAL AND PAYMENT TERMS
By purchasing a Membership, you are joining the FC Naples Season Ticket Membership program that will renew every year under the following payment terms:
Payment Plan Options
Members may select one of the following plans:
Annual Plan: Pay 100% of the cost of the Membership in a single payment. Payment is automatically processed for the following Season on the Club’s designated renewal date unless the Member opts out in writing. Payment may be made using American Express, Discover, MasterCard, or Visa (each a “Credit Card” or “Debit Card”).
Monthly Installment Payment Plan: Pay for the cost of the Membership for the next Season in equal monthly installments, with the final payment occurring in August. Unless written notice of non-renewal is delivered to FC Naples, payments for each new Season will commence on the Club’s designated renewal date. Each monthly payment will be automatically charged via Credit Card or ACH.
Two-Year Season Ticket Plan (“Two-Year Plan”): By selecting and purchasing a Two-Year Plan, the Member agrees to purchase a Season Ticket Membership for the subsequent Season following the initial Season covered by the Two-Year Plan. Pricing for the subsequent Season will be at the rate in effect at renewal for Two-Year Plan Members.
If a Member elects to opt out of the second Season prior to its commencement, the Member shall be assessed an early termination penalty equal to:
The total amount of per-seat savings received for the initial Season as compared to the applicable one-year plan rate at purchase, multiplied by the number of seats in the Member’s account; plus
A $150.00 per account fee.
The $150.00 portion will be applied as a credit to the Member’s account for future FC Naples tickets. The per-seat savings portion is non-refundable and will not be credited toward any future purchases. All penalties under this provision are subject to the same processing fees applicable to Membership payments. Failure to pay the penalty (including processing fees) in full by the due date specified by FC Naples will constitute a breach of this Agreement and may result in loss of all Membership privileges.
Processing Fee
All payments are subject to a processing fee.
Late Payment Fee
All payments shall be made on the same calendar date each month as established by the Member’s selected payment plan start date, without demand, to FC Naples, LLC, as applicable. In the event any Membership payment is delinquent for ten (10) days or more from its scheduled due date, the Member shall be liable for and agrees to pay a delinquent charge of $15.00 for general seating or $30.00 for any premium seat, as determined by FC Naples.
Automatic Ticket Renewal
By purchasing a Membership for the upcoming Season, Members agree to automatic renewal on the Club’s designated renewal date for the next Season unless written notice of non-renewal is delivered to FC Naples.
Each year, FC Naples will send a renewal notice at least thirty (30) days prior to the renewal date, specifying new pricing, any changes to Membership Benefits, and ticketing policies. Members who opt out will retain Membership status for the current Season, and all current Season payments must still be completed.
If no cancellation notice is received by the renewal date, tickets will automatically renew, and the first payment will be due in accordance with the selected payment option.
Any price changes will be communicated at least thirty (30) days before implementation. Members may select a different payment plan prior to the renewal date; changes are not effective until confirmed by FC Naples.
Memberships cannot be suspended. If a Member cancels, re-enrollment is subject to availability and then-current pricing and benefits.
By purchasing a Membership, each Member authorizes FC Naples to automatically, without further notice, initiate debit or credit card payments as selected by the Member.
Pay As We Play Program for Additional Matches & Playoffs
Members in good standing are automatically enrolled in the Pay As We Play Program for matches outside of the standard Season Ticket Benefits (e.g., USL Playoffs, Leagues Cup, CONCACAF Champions League, Lamar Hunt U.S. Open Cup). FC Naples will invoice Members for the same seats held in their Membership. Members may opt out within the designated Opt-Out Period (minimum of 48 hours). Failure to opt out will authorize FC Naples to charge the payment method on file.
Individuals Under 18 Years of Age
Any person under the age of 18 who enters or attempts to enter the Pitch without authorization will be subject to the following consequences:
- Immediate ejection from the Venue.
- Issuance of a Trespass Warning by CCSO.
- Minimum two (2) week ban from PCSC, including all FC Naples events, with the exact duration and terms of the ban determined at the discretion of PCSC management.
- Minimum six (6) game ban from FC Naples events.
